Program Description

Fraud!  We throw the term around a lot--especially in bankruptcy-- but what does it really mean?  When can your credit union avoid the effect of a bankruptcy case by proving fraud?  Is there anything your credit union should consider when drafting its lending policies and procedures, or when handling collection matters, that will help it fight fraud in bankruptcy cases that arise later?

The term "fraud" has specific meaning in litigation, and has special rules in bankruptcy cases.  If your credit union can prove loan fraud or bankruptcy fraud, you can avoid having your debt discharged. But if you attempt to prove fraud and fail, you can get stuck with the debtor's attorneys fees as well as your own.  Doing nothing can result in the loss of funds the credit union really could have recovered.  It's important to know the rules!
