Discovery
of Electronically Stored Information
Program
Description The fact is that new federal Rules of Civil Procedure, combined with an evolution of the law over the past few years, makes this a subject every credit union professional who handles subpoenas from third parties, or who works with attorneys to defend the credit union in litigation must understand. When the problem arrives on your credit union's doorstep, there will be steps the credit union must be immediately prepared to take. If you haven't prepared, you won't be ready to comply. The short version is that developments in the law in recent years make it increasingly likely the credit union will be required to produce information stored in its computers, backup drives, Blackberries and other PDAs, cell phones, and even stored answering machine messages in response to discovery requests -- and that the production will be required in electronic format. Further, the credit union must be prepared to take affirmative steps to prevent destruction of any of this information on very short notice -- and that means you must understand where the information is! Failure to preserve and produce information can result in severe penalties. Lawyers wrote these rules, so the details are, of course, more complex. On April 19, credit union attorney Eric North will tell credit unions exactly what they need to know in order to deal with electronic discovery issues.
