In the Wake of the Juarez Decision

PROGRAM DESCRIPTION --
On June 26, 2007, the California Court of Appeal
for the Fourth Appellate District issued a sweeping decision that may
have invalidated the repossession sale notices used by financial institutions
(including credit unions) across the state, and that calls into
question the collectability of millions of dollars worth of deficiency
balances.
| According
to the appellate court, repossession notices are invalid in many
instances unless they contain much more detail about how much a
debtor must pay to reinstate a loan, who payment must be made to,
and what circumstances might require additional payments -- than
most financial institutions have provided. |

decision, which interprets the law much more strictly than any published
decision before it, is likely to cause a new spate of class action
lawsuits! Credit unions across the state are scrambling to figure
out how the case affects them, and what to do about it.
During this program, Eric
North -- a credit union attorney with more than 20 years experience
prosecuting and defending lawsuits involving credit unions, and the

spoke with credit union professionals from California, and with credit
unions from other states doing business in California, regarding:

the legislature said in the Civil Code, and why no one saw this
coming. |

the validity of the repossession sale notices your credit
union has been using. |

collect deficiency balances from past repossession sales,
and what you should consider when deciding whether to pursue --

the options are for overturning or otherwise limiting the Juarez
decision, what steps are being taken right now in that regard,
and how those steps affect your credit union's decision making. |
