Most
documents filed on behalf of
creditors in bankruptcy cases are filed by their attorneys.
But proofs of claim are usually filed directly by the
creditor. That doesn't necessarily make them easy to
prepare, or mean that most are done right!
A
number of lawsuits have been filed recently against creditors
(and sanctions have been imposed) because improper information
was included in proofs of claim.
On
the other hand, many courts routinely reject proofs of claim
that do not include enough information and supporting
documentation.

program, attorney Eric North talks with credit unions
about when, how, and why to complete this most basic task: filing
proofs of claim, and discusses the details you need
to know in order to properly protect your credit union's claim.
