Almost
all credit union loan agreements have them, but few credit unions
use them -- or are even sure whether they can use
them.
"Default upon bankruptcy" clauses
-- sometimes called
"ipso facto clauses" -- say the creditor may
declare a default if the debtor files bankruptcy. Those
clauses may have vital importance to credit unions if they are
enforceable, but mean nothing and may cause you liability if
they are not enforceable. And no one seems to know what the law really says!
Credit union rights attorney Eric North has studied and followed
court cases relating to this issue for more than 20 years, and
on November 20 he will talk with participants about why these clauses
are so very important to secured creditors in Chapter 7 bankruptcy
cases and how your credit union can best utilize them. |
