Proofs of claim serve a vital purpose in consumer bankruptcy cases—especially Chapter 13 matters. Failing to file one may cause payment of your claim to be delayed or cause all or part your claim to be lost entirely. Filing one incorrectly may have the same result or may even trigger substantial penalties!

In fact, it isn't just the proof of claim form that has to be completed and filed correctly; you must also properly prepare an itemization of the amount claimed (sometimes you must use an official form; sometimes you can't), update your proof of claim using official forms in certain situations, and even withdraw your claim if certain things happen.

Meanwhile, there are documents you must attach in order for your claim to be valid, but if you attach too many documents you might unnecessarily create problems!

During this 90 minute (approximately) program, attorney Eric North (see sidebar) works with participants to explain just what you must, may and must not do when preparing and filing a proof of claim for unsecured, personal property secured, and real property secured claims. Participants will learn—

Exactly how to complete the official Proof of Claim form.
How to itemize principal, interest, late fees, attorneys fees, and any other amounts included in the claim (including when you must and when you can't use the official form).
What "Supplement 1" and "Supplement 2" are used for, how to complete them, and what happens if you don't do it correctly.
What other attachments must be included with the proof of claim.
How a debtor may object to your original claim or to fees or charges you add during the term of the bankruptcy case, and how to respond.
What information you are prohibited from including with a proof of claim and what your financial institution should do if you make a mistake.
What your duty is when a Chapter 13 provides your financial institution with a Notice of Final Cure Payment.
Common errors creditors make and how to avoid or fix them.
